As best as I can figure, the top and bottom valves just stop the water from entering the tank. The middle valve lets it flow through the bypass pipe from the cold lines to the hot lines to circulate...

It looks like all 3 are open in the picture and no check valve at the output of the water heater at the top so water would be flowing into and out of the tank and some would be bypassing it as well....

Yes, there will be pressure in the tank even when cold. When the tank fills there should be a pocket of air trapped at the top of the tank that will be pressurized from whatever the filling water...
